WCTV’S “ROWE ROOFING I NEED A NEW ROOF! CONTEST 2009” OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
1.PROMOTION DATES
a.WCTV’s “Rowe Roofing ‘I Need A New Roof!’ Contest” (“Promotion”) will begin at 12:00pm Eastern Time (“ET”) on 11/10/2009 and end at 5:00pm ET on 12/15/2009.
2.ELIGIBILITY RESTRICTIONS
a.The Promotion is open to all legal residents of the United States and the District of Columbia (except NY) who are 21 years of age or older as of November 9, 2009 and who live in the North Florida and South Georgia counties of Leon, Jefferson, Wakulla, Gadsden, Thomas, Bainbridge, Cairo, Brooks, Lowndes, Madison and Taylor. Entrants must be homeowners as of November 9, 2009 or have given permission to someone else to enter them in the contest and must have the requisite rights to repair and replace their roof of their home in the geographic area of the Promotion. Employees of WCTV(TV) (the “Station”), Rowe Roofing, Inc., their parent, subsidiary, and affiliated entities ("Rowe Roofing"), their advertising agencies, participating sponsors/promotional partners, other broadcasting stations in the Tallahassee-Thomasville metropolitan areas, and the members of their immediate families (spouse, parents, siblings or children) or households are ineligible to participate or win. This Promotion is subject to all applicable federal, state, and local laws and regulations. Void outside the United States, in NY, as applicable, and where prohibited.
b.Only one entry and one winner per household is permitted in any Station contest/sweepstakes regardless of the method of entry.
c.Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
3.ENTRY
a.To participate in the Promotion, you may enter via the following method(s):
VIA INTERNET – Visit WCTV’s online contest webpage at www.wctv.tv/contests and follow the links and instructions to complete an Official Entry Form online. Submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth, valid email address, and approximate roof dimensions in the online entry form no later than December 15, 2009 at 5:00pm ET. At the time of entry, entrants must also upload an essay explaining “Why you need a new roof?” Finally, at the time of entry, entrants must upload at least one (1) photo images of their roof or a brief video MPEG file (not to exceed five minutes). The images or video must include the exterior of your roof. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning the email address or the domain associated with the submitted email address. Multiple entrants are not permitted to share the same email address. All entries submitted become the sole property of the Station and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. The contest/sweepstakes administrator’s computer is the official time keeping device for the Promotion.
VIA POSTAL MAIL – Entrants may also legibly handwrite their first name and last name, complete address, city, state, zip code, telephone number, date of birth, valid email address, and approximate roof dimensions on a 3x5” card and include an explaining “Why you need a new roof?” The essay can be on a separate sheet of paper 8-1/2x11" attached to the card. Further, entrants must submit at least one (1) photograph of their roof or a brief video (VHS or DVD) (not to exceed five minutes). The images or video must include the exterior of your roof. Mail in entries and videos or photographs must be postmarked by December 15, 2009 and received no later than December 18, 2009. Entries must be mailed to: WCTV, I Need a New Roof Promotion Entry, 1801 Halstead Blvd, Tallahassee, FL 32309.
b.Videos, photographs, images and essay submissions (“Content”) must each be the entrants’ original, creative work. Further each entrant must own the copyright in the Content and have the right to submit it. The Content may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights including but not limited to copyrights or trademarks. Each photograph or video submission must include the entrant’s roof. The Content must not contain copyrighted materials or any other materials that may be restricted, prohibited or outlawed by federal, state or local laws. Station, in its sole discretion, reserves the right to disqualify any entry if such entry contains illegal, indecent or otherwise offensive material, or if such entry contains material whose content is deemed at the sole discretion of the Station to be unsuitable for public display, broadcast, or posting on the Station’s website (i.e., entries must be broadcast clean). Entries that do not comply with these rules will not be eligible for the competition.
Only one entry per person and one entry per email address are permitted regardless of method of entry. For postal entry, only one entry may be submitted per outer mailing envelope.
4.PRIZES
a.One (1) Grand Prize: a nontransferable Rowe Roofing prize certificate valid for a new roof makeover, which may include new 30 year shingles and all additional material and labor such as felt, drip edge, etc. not to exceed $18,000 in value. Actual value of the prize certificate shall not exceed $18,000, and will vary depending upon the dimensions of the prizewinner’s home. Prize certificate is valid for 90 days and may only be redeemed by the prizewinner for services within the North Florida and South Georgia counties of Leon, Jefferson, Wakulla, Gadsden, Thomas, Bainbridge, Cairo, Brooks, Lowndes, Madison and Taylor.
b.The foregoing allowances represent good faith estimates of the values of the various components of the makeover project to be awarded and the actual value of the Grand Prize makeover project may differ depending on the specific details of the project. The Grand Prize Winner will be notified of the final retail value of the Grand Prize after the renovation is complete. Under no circumstances will Rowe Roofing be obligated to award a Grand Prize roof renovation package valued at more than $18,000 and any difference between the approximate and final, actual value of the roof renovation project will not be awarded. All costs and expenses associated with the roof renovation project in excess of the project allowances set forth above will be the sole responsibility of the Grand Prize Winner. The Grand Prize Winner must cooperate fully with Rowe Roofing and the roof design consultants, suppliers and contractors selected by Rowe Roofing during the makeover project, and the Grand Prize Winner is solely responsible for obtaining and paying the costs of any permits, inspections or licenses required by applicable laws, regulations or ordinances to complete the makeover project. The Grand Prize roof is provided "as is" without any express or implied warranty of any kind from Rowe Roofing, including warranties of merchantability, or fitness for a particular purpose.
c.There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
5.WINNER SELECTION AND NOTIFICATION
a.Decisions of Station management with respect to the Promotion are final.
b.A panel of three(3) to four (4) Judges (“Contest Judges”) appointed by Station will evaluate all of the eligible entries received to select finalists based on the following judging criteria: (1) degree of damage/ challenge depicted in the entry and the potential for improvement of the contestant's roof's appearance and design (30%); (2) quality of the contestant's essay explanation as to why his or her roof deserves the Grand Prize new roof (30%); and (3) the overall potential of the roof project for on-air appeal to the audience of WCTV (40%).
c.On or about December 16, 2009, potential finalists will be selected and must be available for Station and/or Rowe Roofing staff members to view their roof the week of December 16, 2009. On or about December 23, 2009 the three (3) finalists will be selected and be notified.
d.The finalist entries selected by the Contest Judges will be posted on the WCTV.TV "I Need a New Roof" contest page. Station reserves the right in its sole discretion to the edit finalists' essays and request addtional photos and/or video footage to post on WCTV.TV that the Station believes most clearly depicts the finalist's roof. WCTV.TV website visitors will vote for one finalist’s roof that they believe is most in need of a new roof between December 16, 2009 and December 23, 2009. Only one vote per person and one vote per email address. On or about December 25, 2009, one (1) Grand Prize Winner will be selected based on the largest cumulative number of online votes received between December 16, 2009 and December 23, 2009 and notified that he/she is the winner. Winner need not watch WCTV or be present to win.
e.In the event of a tie in online votes, the Contest Judges will reevaluate the tied entries using the criteria described above to select one (1) Grand Prize Winner.
f. The roof renovation period is currently scheduled to take place between January 1, 2010 and March 31, 2010; however if the roof renovation project is not completed within this time period due to inclement weather, natural conditions or other reasonable delay, the Grand Prize Winner and Rowe Roofing will mutually agree upon alternate dates for the roof renovation to occur. Station shall have no liability to the Grand Prize Winner in the event of any delay or problems regarding the completion of the roof renovation project.
g.Winners (or their parents or legal guardians if under the age of majority) must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited and an alternate winner may be chosen by taking the finalist with the next highest number of votes. If a potential winner cannot be contacted, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner will be disqualified and will forfeit the prize.
h.Unless otherwise specified in the prize notification, all prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within ten (10) days of winning. Prize or prize certificates will not be mailed to the winner without the winner’s prior written consent in which the winner shall agree to assume its risk of loss. The Station, Rowe Roofing, and promotional partners are not responsible for the safe arrival of a prize or prize certificate.
6.CONDITIONS
a.Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners will be required to complete and submit an IRS Form W-9 or the equivalent including the winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b.By participating in the Promotion, each winner agrees to have his or her name, city, state, voice, likeness, essay submission, or photograph or video submission used in any advertising or broadcasting material relating to this Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. Further, by participating in the Promotion, each winner acknowledges and agrees the Station will videotape and document the progress of the renovation project throughout the renovation period. By entering the contest, you agree that a Station crew may enter and videotape your residence on at least six (6) occasions during the renovation period to document the progress of the makeover project and that the Station at its discretion may broadcast, display on its website, or use the video footage of the makeover project in any other manner. By entering the Contest, you grant the Station an irrevocable, non-exclusive royalty-free license to broadcast, display on its website, copy, edit and otherwise use your entry materials, including your photographs, video tape and essay, for any promotional, programming or commercial purpose.
c.Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Station in its sole discretion will require verification of Promotion winner’s identification by a showing of valid government-issued photo identification. By participating in the Promotion, each winner agrees to release hold the Station, its sponsor(s) and promotional partner(s), and each of their parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents and representatives of each of them (collectively, the “Released Parties”) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion. The Station will also require eligible Promotion winners and their guests or travel companions, if any (as well as each of their parent(s) or legal guardian(s), if winners, guests or travel companions are under the age of majority in their state of residence), to sign a liability release confirming such consent.
d.The Station, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of the Station’s web channel or is otherwise in violation of the rules. The Station further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Station’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by the Station in is sole discretion. Any attempt by an entrant or any person to deliberately damage any station web channel or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws. Should such an attempt be made, the Station reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. The Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to modify, suspend or cancel the Promotion and shall not be required to award a substitute prize.
e.The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals; or (iii) lost, stolen, mangled, misdelivered, postage due, illegible, incomplete, incorrect, or late entries.
f.To obtain a copy of the Official Rules or a list of winners following completion of the Promotion (please specify which), send a self-addressed, stamped envelope (VT residents may omit return postage) specifying “Official Rules” or “Winner List” to WCTV’s “I Need A New Roof! Contest” Winner List or Official Rules Request, WCTV(TV), 1801 Halstead Blvd, Tallahassee, FL 32309. A copy of the Official Rules and a list of winners (when complete) are also available during regular business hours at the main studio of WCTV(TV), at the same address. All such requests must be received within thirty (30) days following completion of the Promotion.
7.TERMS OF USE AGREEMENT & PRIVACY POLICY
a.By use of this web channel and by entering this Promotion, you agree to the Station’s Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: http://affiliates.upickem.net/Engine/DesignPrivacyPolicy.aspx.
