WCTV Halloween Costume Contest 2013
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. PROMOTION DATES
a. The 2013 WCTV Halloween Costume Contest (“Promotion”) will begin at 5:00:00 a.m. Eastern Time (“ET”) on Friday, October 18th, 2013 and end on Thursday, November 7th, 2013 at 1:00:00 p.m. ET. The deadline for online entries is 11:59:59 p.m. ET on Friday, November 1st, 2013. The deadline for online voting is 12:00:00 p.m. noon ET on Thursday, November 7th, 2013.
2. ELIGIBILITY RESTRICTIONS
a. The Promotion is open to all legal residents of the United States and the District of Columbia who are 18 years of age or older at the time of entry and who live in Georgia and Florida. Employees of WCTV (the “Station”), its parent, subsidiary, and affiliated entities, its advertising agencies, participating sponsors/promotional partners, other broadcasting stations in the North Florida, South Georgia metropolitan area, and the members of their immediate families (spouse, parents, siblings or children) or households (whether related or not) are ineligible to participate or win. This Promotion is subject to all applicable federal, state, and local laws and regulations. Void outside the United States, as applicable, and where prohibited.
b. Only one winner per household is permitted in any Station-conducted contest/sweepstakes.
c. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and will also delete any entry as required by law.
3. ENTRY
a. To participate in the Promotion, you may enter via the following method(s):
VIA INTERNET – To enter, log onto http://www.wctv.tv/contests and click on the WCTV Halloween Costume Contest display ad which will direct to the WCTV Halloween Costume Contest Page. Follow the links and instructions to enter and submit your first name and last name, complete address, city, state, zip code, telephone number, date of birth, a valid email address, and a photo of the entrant or the entrant’s child(ren) that best illustrates the theme “Halloween Costume” (“Photo Submission”) in the online entry form. Persons under the age of 13 may not enter the Promotion. Only the parent or legal guardian of a person under the age of 18 years old may submit a photo of his or her child(ren). Additionally, if you have not already “LIKED” the Station Facebook page, you must “LIKE” the Station Facebook page before you can enter the Promotion. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address. Multiple entrants are not permitted to share the same email address. Entries submitted will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Station. The contest/sweepstakes administrator’s computer is the official time keeping device for the Promotion.
Photo Submissions must be the entrants' original, creative work, and must not be protected by copyright; each entrant must have the right to submit it. The Photo Submissions may not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person's personal or proprietary rights including but not limited to copyrights or trademarks. Incomplete and/or multiple and/or duplicate entries by the same or multiple entrants will be disqualified. Valid entries must contain all information requested. The photo submissions must not contain copyrighted materials or any other materials that may be restricted, prohibited or outlawed by federal, state or local laws. Station, in its sole discretion, reserves the right to disqualify any entry if such entry's associated Photo Submission or other content contains illegal, indecent, pornographic, sexually explicit content or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse, or if such Photo Submission or other content contains any nudity, material whose content is deemed at the sole discretion of the Station to be unsuitable for public display or posting on the Station's website. Entries that do not comply with these rules will not be eligible for the competition. Photo Submissions will be posted on the Station's website, and by submitting a photo, entrant certifies that he or she has the permission to post the photo. The person submitting the photo must be the person or the parent or legal guardian of the person in the photo. Entries that do not comply with these rules will not be eligible for the Promotion.
Each entrant understands and agrees that he/she has no right to approve or control the manner in which the Photo Submission may be used or displayed. Each entrant further understands that the use and exploitation of the Photo Submission may subject entrants to risk of notoriety, publicity, ridicule, scorn and/or indignity.
b. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. By submission of an entry, an entrant releases Facebook from any responsibility or liability for the Promotion’s administration, prizes or promotion. You are providing entry information to WCTV and not to Facebook.
c. For internet entry, only one (1) entry per person and one (1) entry per email address are permitted.
4. PRIZES
a. One (1) prize will be awarded. The prize includes one (1) baked ham and one (1) $50 Visa Gift Card. The Approximate Retail Value of the prize is $100.00. The gift card will be subject to the terms and conditions as set forth by the issuer of the gift card. Gift cards are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time, nor will gift card be replaced if lost or stolen.
b. There is no substitution, transfer, or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
5. WINNER SELECTION AND NOTIFICATION
a. Decisions of Station management with respect to the Promotion are final.
b. After all the general entries have been received by the November 1, 2013 submission deadline date, the public will then vote on their favorite photos to select the grand prize winner based on the most votes received by the voting deadline date, as detailed below. In case of a tie, where the top entrants receive the same amount of votes, a random drawing between the tied photos will determine the winner.
c. Voting will begin on November 2, 2013 at 12:00:00 a.m. midnight ET and end on November 7, 2013 at 12:00:00 p.m. noon ET (“Voting Period”). All eligible Photo Submissions will be posted at http://www.wctv.tv/contests during the Voting Period. The Photo Submission with the most votes at the end of the Voting Period will be the winner. Only one (1) vote per person per day will be permitted. The grand prize winner will be contacted by WCTV either by email and/or by phone to be notified of their winning and how to obtain their prize by 1:00:00 p.m. ET on November 7, 2013.
d. Odds of winning depend in part upon the number of entries received.
e. Winners do not need to watch the Station or be present in order to win.
f. Winner(s) (or their parents or legal guardians if under the age of majority) must execute and return any required affidavit of eligibility and/or liability/publicity release within ten (10) days of notification attempt or winner will be disqualified and the prize will be forfeited and an alternate winner(s) may be chosen at random of the other eligible entries. If a potential winner(s) cannot be contacted, fails to complete, sign and return the required affidavit of eligibility and liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner(s) will be disqualified and will forfeit the prize.
g. Unless otherwise specified in the prize notification, all prizes or prize certificates may be picked up at the office of the Station at the address below. The winner(s) will forfeit any prize or prize certificate not claimed within ten (10) days of winning. Prize or prize certificates will not be mailed to the winner(s) without the winner’s or winners’ prior written consent in which the winner(s) shall agree to assume its risk of loss. The Station, its sponsor(s), or promotional partner(s) are not responsible for the safe arrival of a prize or prize certificate.
6. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winner(s). Winner(s) will be required to complete and submit an IRS Form W-9 or the equivalent including a winner’s full Social Security Number for receipt of any prize valued at $600 or more or for any prizes awarded by the Station in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.
b. Participating in the Promotion and acceptance of prize constitutes a winner’s and guest’s (where applicable) permission for the Station or its agents to photograph, film and record each winner, and to use his/her name, address (city and state), likeness, photograph, voice, biographical information and/or any statements made by him/her regarding the Promotion or its sponsors for purposes of trade, publicity or promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. A guest or travel companion will be required (when applicable) to sign a separate release.
c. Prior to awarding any prize or prize certificate, and depending on the nature of the prize and eligibility requirements of the Promotion, the Station in its sole discretion will require verification of Promotion winner’s or winners’ identification by a showing of valid government-issued photo identification. By participating and/or accepting a prize, entrants, winner(s) and guests (if applicable) agree to release and hold harmless the Station, its sponsor(s) and promotional partner(s), its advertising and promotion agencies, and each of their respective parent, subsidiary and affiliated entities, and the officers, shareholders, directors, employees, agents, representatives, successors, and assigns of each of them (collectively, the “Released Parties”) harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion. The Station will also require eligible Promotion winner(s) and their guests or travel companions, if any (as well as each of their parent(s) or legal guardian(s), if winner(s), guest(s) or travel companion(s) are under the age of majority in their state of residence), to sign a liability release confirming such consent. It is the responsibility of the winner(s) to ensure that their guest(s) or travel companion(s) sign and return to the Station any required release.
d. The Station, in its sole discretion, reserves the right to disqualify any person (and all of their entries) from this Promotion if he or she tampers with the entry process, the operation of the Promotion, or the operation of the Station’s web channel or is otherwise in violation of the rules. The Station further reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Promotion, or any part of it, if it is not capable of completion as planned or if any fraud, technical failures or any factor beyond the Station’s control, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion as determined by the Station in is sole discretion. Any attempt by an entrant or any person to deliberately damage any station web channel or to undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws. Should such an attempt be made, the Station reserves the right to seek full prosecution and/or damages from any such individual to the fullest extent permitted by law. The Station’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to modify, terminate, suspend or cancel the Promotion and shall not be required to award a substitute prize.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize; (ii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, malfunctions, disconnections, other technological failures, telephone service outages, delays, dropped calls, or busy signals, or any other difficulties that may prevent an individual from sending or receiving a text message; or (iii) lost, stolen, mangled, misdirected, postage due, illegible, incomplete, incorrect, or late entries. Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of god, acts of war, natural disasters, weather, acts of terrorism or other factors beyond the Station’s control.
f. To obtain a copy of the Official Rules or a list of winner(s) following completion of the Promotion (please specify which), send a self-addressed, stamped envelope specifying “Official Rules” or “Winner List” to 2013 Halloween Costume Contest Winner List or Official Rules Request to WCTV, 1801 Halstead Blvd. Tallahassee, FL 32309. A copy of the Official Rules and a list of winner(s) (when complete) are also available during regular business hours at the main studio of WCTV, located at 1801 Halstead Blvd. Tallahassee, FL 32309. All such requests must be received within thirty (30) days following completion of the Promotion.
7. TERMS OF USE AGREEMENT & PRIVACY POLICY
a. By use of this web channel and by entering this Promotion, you agree to the Station’s Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: “http://www.wctv.tv”.
